Terms & Conditions
Last Updated: September 29, 2026
These Terms & Conditions ("Terms") govern your access to and use of the zavoka AI website, Shopify application, AI Sales Executive, dashboard, and related services (collectively, the "Service"). In these Terms, "zavoka," "we," or "us" means the operator of the Service (AI), and "you" means the person or business using it. By accessing or using the Service, you agree to these Terms. If you use the Service for a business, you confirm that you are authorized to accept these Terms for that business.
1. Eligibility and merchant account
You must be legally able to enter a binding agreement to use the Service. You are responsible for providing accurate store and contact information, keeping your login/session credentials secure, and all activity carried out through your account. Notify us promptly if you believe your account has been accessed without authorization.
2. The Service and Shopify
zavoka provides AI-assisted shopping conversations and merchant tools, which may include product recommendations, analytics, and cart-related features. Features may change or be unavailable from time to time. You must have a compatible Shopify store and authorize the permissions needed for the features you choose to use.
Shopify is a separate third-party platform. Your use of Shopify is governed by Shopify's own terms and policies. We do not control Shopify and are not responsible for its services, availability, decisions, or changes to its platform or requirements. You are responsible for complying with Shopify's terms and applicable app-store requirements.
Some features may be identified as beta, preview, or experimental. These features are provided for evaluation, may change or be withdrawn at any time, and may be subject to additional terms or limitations. Unless required by law, preview features are provided without a commitment that they will become part of the generally available Service.
3. Trial, subscriptions, payments, cancellation, and refunds
3.1 Free trial
Trial availability, duration, usage allowance, and features are described on our website and at sign-up. The current public offer is a 5-day Premium trial with up to 50 AI chats, whichever limit is reached first. The trial requires no credit card, and no subscription fee is charged during it. When the trial ends or its chat limit is reached, the service pauses unless you choose and activate a paid plan; the trial does not automatically convert into a paid subscription. If you use the full 5-day trial and then activate a paid plan, the trial plus the separate 10-day refund-request window described in Section 3.4 amounts to up to 15 calendar days from the start of the trial. The refund-request window begins only when a paid subscription payment is made; it is not an additional free-use period.
3.2 Subscriptions and payments
Subscription fees, billing frequency, included features, and any applicable usage limits will be displayed before you subscribe and confirmed at checkout. The details shown at checkout apply to your subscription. Payments are processed by Stripe or another payment provider identified during checkout, and that provider's terms may also apply.
When you subscribe, you authorize zavoka and its payment provider to charge your selected payment method for the applicable subscription fees, taxes, and recurring renewals. Autopay is on by default for paid subscriptions, which renew automatically for the billing period shown at checkout unless you turn autopay off or otherwise cancel before renewal. You are responsible for keeping your billing details current and for charges incurred before cancellation takes effect. We may change subscription fees for future billing periods and will provide notice of material changes where required by law. A change will not affect a billing period already paid. You are responsible for applicable taxes, excluding taxes on our net income.
3.3 Cancellation
You can manage autopay for an active paid subscription in the Billing section of the merchant dashboard. Autopay is on by default. Turning it off schedules your subscription to end at the close of the current billing period: you keep paid access through that period, and no renewal payment will be taken for the next period. You may turn autopay back on in the dashboard before the current period ends to resume renewals. You may also request cancellation by contacting contact@zavoka.com. Make changes before the renewal is processed to avoid the next charge. Turning autopay off or canceling does not reverse a payment already processed or automatically issue a refund.
If you cancel during the free trial, no paid subscription will begin automatically; the trial ends when its time or chat limit is reached, unless you separately activate a paid plan.
3.4 Refunds
You may submit a refund request for a paid subscription payment within 10 calendar days after the payment date. The 10-day window applies separately to each payment. Your request must be received no later than the 10th calendar day after the payment. A request received on or after the 11th calendar day is late and will not be considered for a refund, except where a refund is required by applicable law. Submitting a request within the window makes it eligible for review but does not guarantee approval. If you take the full 5-day trial and activate a paid plan when the trial ends, the combined trial and refund-request period is up to 15 calendar days from the start of the trial; the final 10 days are paid subscription time and are not free.
To request a refund, email contact@zavoka.com within the 10-day window. Include your store URL, billing email, payment date, and a clear statement that you are requesting a refund. If you also want to stop future renewals, request cancellation separately using the method in Section 3.3; requesting a refund does not cancel your subscription. Approved refunds are normally sent to the original payment method, and processing time depends on the payment provider or your bank.
4. Acceptable use
You must use the Service lawfully and only for its intended purposes. You must not:
- violate any law, third-party right, Shopify requirement, or applicable platform policy;
- use the Service to send unlawful, deceptive, harassing, discriminatory, or infringing content;
- attempt to gain unauthorized access, disrupt or overload the Service, or bypass usage limits or security controls;
- reverse engineer or copy the Service except where applicable law does not allow that restriction; or
- use AI outputs as a substitute for professional, legal, medical, financial, or other regulated advice.
5. Your store, content, and customer obligations
You retain your rights to information and content you submit or connect to the Service ("Merchant Content"). You grant us a limited, non-exclusive right to host, process, transmit, and display Merchant Content only as reasonably necessary to provide, secure, and support the Service.
You are responsible for the accuracy and legality of your product catalog, prices, inventory, shipping, returns, promotions, and other store policies. You must provide any notices and obtain any permissions or consents required to use shopper data and AI chat features in your store. Do not submit sensitive personal information unless the Service specifically supports it and you have a lawful basis to do so.
6. AI-generated content
The Service uses automated systems and AI. Responses and recommendations may be incomplete, inaccurate, outdated, or unsuitable and should be reviewed before you rely on them or display them to customers. AI outputs are not guarantees of sales, conversions, or business results. You are responsible for supervising the assistant, setting appropriate behavior, and correcting misleading or inaccurate store information.
7. Privacy and data
Our Privacy Policy explains how information is handled. You must not use the Service in a way that conflicts with that policy or applicable data-protection laws. Where you provide or make personal information available through your store, you remain responsible for your obligations to the people whose information it is.
8. Intellectual property
The Service, including its software, design, branding, and materials, is owned by zavoka or its licensors and is protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Service during your subscription or authorized access. No ownership rights are transferred to you.
9. Third-party services
The Service may integrate with or link to third-party products, including Shopify, payment providers, and AI services. Those products are governed by their own terms and privacy policies. We do not warrant or control third-party services, and are not responsible for their acts, omissions, or availability.
10. Availability, changes, and suspension
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may update, restrict, or discontinue a feature. We may suspend or limit access if reasonably necessary to protect the Service, comply with law, address security concerns, or respond to a breach of these Terms. Where practical, we will give notice and an opportunity to address the issue.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise any particular level of revenue, conversion, customer engagement, or business performance. Nothing in these Terms limits rights or warranties that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, zavoka will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, revenue, goodwill, data, or business opportunity arising from or related to the Service. To the fullest extent permitted by law, our total liability for claims relating to the Service will not exceed the fees you paid to us for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify zavoka and its personnel against third-party claims, losses, and reasonable costs arising from your Merchant Content, your store or products, your use of the Service, your violation of these Terms, or your infringement of another person's rights. We will give you reasonable notice of a claim and cooperate at your expense.
14. Term and termination
These Terms apply while you use the Service. You may stop using the Service and cancel a subscription as described above. We may terminate or suspend access for a material breach, legal requirement, or discontinued Service. On termination, your right to use the Service ends. Sections that by their nature should continue, including intellectual property, disclaimers, liability, indemnity, and general provisions, will survive.
15. Changes to these Terms
We may revise these Terms as the Service or applicable requirements change. We will post the revised version here and update this page. If a change is material, we will take reasonable steps to notify affected users. Continued use after the effective date of revised Terms means you accept them; if you do not agree, stop using the Service.
16. General
If any part of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our prior written consent; we may transfer them as part of a business reorganization or transfer of the Service. These Terms and the policies they reference are the agreement between you and us about the Service, subject to any separate written agreement we have signed with you.
17. Service communications
We may send service, security, account, trial, and billing notices related to your use of the Service. These operational communications are not promotional messages and may be sent when reasonably necessary to provide, administer, or protect the Service.
